Research On The Protection Of The Rights And Interests Of Labor Of Migrant Workers Based On Government Responsibility

During China’s reform and opening up and industrialization, urbanization and modernization, migrant workers has been growing and expanding to a new industrial army. According to statistics, in 2013, the total number of migrant workers has reached 269 million people, including 166 million migrant workers. As a new group, migrant workers has brought great historical contributions to China’s social and economic development, but also produced a series of problems. Due to the weak position of migrant workers, labor rights and interests protection for migrant workers is particularly important. It related to the future development of migrant workers and the basic pattern of our country’s economy and society.This article will combine the basis of existing research at home and abroad, from the perspective of government responsibility, use the justice theory, Keynesian, and related interpretation of the responsible government theory to study the labor rights and interests protection problems for migrant workers. Using the methods of literature analysis, comprehensive analysis, analyses the present situation of the injuries to migrant workers’ rights and interests of labor.And analyzes the responsibility of government, which is social concept guide, public service provider, the provider of financial capital, legal, policy makers, practitioners and regulators in the labor rights and interests security of migrant workers. On further study, this paper found the dereliction of duty of the government, such as the missing of consciousness to protect the labor rights and interests of migrant workers; the household registration system is unreasonable; the social security and legal system are not perfect and the government’s own management pattern has deviation. To solve these problems, we should improve the government responsibility in the protection of labor rights and interests of migrant workers. Start from the household registration system reform, perfecting the legal system, social organization support, and then strengthen the relationship between the government and community to build a pattern which can protect the labor rights of migrant workers effectively.
