A Research On Government’s Purchase Of Public Law Services

Based on the construction of service-oriented government which should be efficient, transparent and satisfying, the government’s purchase of public legal services has gradually been put on the agenda in recent years. The reports of the 18 th National Congress of CPC and the fourth plenary session indicate that we need to “speed up the formation of public service system which covers both both urban and rural areas. This system should also be sustainable and government-leading. The reports also indicate that we should “promote the government’s purchase of services and establish a system of legal counsel”. The reports point out the direction for the work of government’s purchase of public legal services. This paper expounds respectively the concept, main types, construction requirements and supply modes of public legal services, as well as the path of public legal service in China. The paper takes the basic situation of the purchase of public legal services in Jingjiang City as a point of contact, focused on the basic approaches of legal services(including lawyer services and legal aid), law advocacy and people’s mediation in Jingjiang. The paper explores the problems and reasons of government’s purchase of public legal services by literature research, comparative analysis and empirical analysis, and then put forward to countermeasures such as strengthening the government’s attention, improving the government purchase mechanism, clarifying financial security, developing public legal services product, establishing a high quality public legal service team. It is expected that this paper can make some contributions to promote the government to accelerate the purchase of public legal services effectively, and to achieve the goal of building the full coverage of public legal service system as soon as possible in Jingjiang.
