On The Precedent System Of Administrative Discretion

With the advance of urbanization process in China, the housing levy is also expanding, so that more and more people can share the achievements of Urbanization process.The house is the most significant part of life in Chinese people’s minds.So it’ll be easy to bring public discontent in the housing levy work. Especially in the housing levy compensation, the government’s discretionary space is relatively large, while the people want to get more compensations, administrative decisions made by the Government should balance the interests of all people.To make such a scientific decision,the government should follow the Doctrine of Stare Decisis.However the government usually does not follow the Doctrine of Stare or unreasonable to follow the Doctrine of Stare.it makes the public discontent happen. Widespread and difficult to solve similar problems, which seriously affected the government’s authority and credibility.Although the Doctrine of Stare is not expressly provided in any administrative rules or regulations,the theory of the Doctrine of Stare should exist in administrative rules and regulations.In this paper,the author try to discuss the importance of follow the Doctrine of Stare in administrative decisions,and construct the precedent system to solve the problems in the housing levy work.
