Research On Marx And Engels’ The Rule Of Law And Its Contemporary Value

Marx and Engels’ the rule of law is an important component of Marxist theory. Through a life-time pursuit of happiness for human race, they resisted exploitation and oppression persistently and turned thought and word into a sharp spear, directing at the capitalism.Inspired by their predecessors, Marx and Engels constantly learned from experience,confirmed facts and criticized metaphysics critically. Finally, they stepped out from a world of fantasy to a world of reality, forming a different theory of the rule of law, which has gradually been inherited and developed.This thesis mainly studies the origin, the development process of Marx and Engels’ the rule of law as well as its modern value. Contents are as follows:Introduction consists of the background, the significance of the research, study at home and abroad, the methods and basic ideas.Chapter One introduces the historical background and the theoretical sources of Marx and Engels’ the rule of law. The theoretical sources include Roman law and German classical philosophy.Chapter Two analyses the theoretical change of Marx and Engels’ the rule of law from three periods—formation, development, and maturity, together with its key thoughts.Chapter Three discusses the theoretical and practical value of Marx and Engels’ the rule of law and explores its crucial value on China’s legal construction.Marx and Engels’ the rule of law is not only the basis of the theoretical system of the rule of law in China, but also the theoretical guidance on legal construction of socialism with Chinese characteristics. Based on Marx and Engels’ classical works and literature review, the thesis sorts out the logical development of Marx and Engels’ the rule of law, and concludes its significance to China’s ruling by law. The aim is to build a government and society with the rule of law under the guidance of Marxism’s rule of law, mentally and physically manifesting equity and justice in legal construction of socialism with Chinese characteristics.
