Marx Engels's Ideas About The Legal System And It's Enlightenment To The Construction Of Socialist Rule Of Law

The rule of law is one of the basic tasks and principles of socialist modernization construction.It is also a fundamental objective of establishing socialistic and political society.China is a socialist country in which,the rule of law cannot be formatted without legal principal of Marx Engels.Conducting research on Marx's law is the starting point whereas it is the most valuable and original material.Therefore,it has irreplaceable value for structuring China socialist legal theory.Although Marx and Engels did not have any special discussion on legal problems,they were reflected in plenty of articles.This thesis addresses on concluding the basic principal of Marx Engels' s legal thought,combined with the experience of socialist construction in China,the inquires regarding to issues of current law,exploring on Chinese construction of socialist law,investigating a suitable law in our country and the method of stable development to promote new ideas of spreading rule of law.Thesis is divided into five parts:The first part is introducing the significance of selecting this topic,research circumstances,methods applied and innovation and difficulties points.The second part introduces conditions of forming Marx Engels' s legal system.This thesis suggests that the legal thoughts of Marx Engels is not baseless,but has a solid foundation on social economic,politics and ideological origin of legal theory,the aim of this part is to explain the origin of these.The third part discusses process of forming Marx Engels' s legal system and thoughts.Their legal thought is not standing in the position of proletariat materialism at beginning.However,it is developed according to the different environment.This part is discussed by referring the development process.The fourth part is analyzing the basic position,value pursuit,and the fundamental ideas of establishing socialist rule of law by organizing Marx Engels' s legal system and thoughts.It is the most essential part of thesis.The final part of thesis is to provide necessary advices of achieving rule of law in China by applying practices of Chinese socialist legal construction and perspectives of Marx Engels' s law thoughts.This is also the reason to write this thesis.
