The South China Sea, which is located in the southeast of China’s land margin of the sea.The water area is about three million six hundred and fifty thousand square kilometers, ranking third in the world. The vast expanse of the sea contains a wealth of strategic resources, but also an important channel for international trade. China is beyond all dispute sovereignty for this area since ancient times. Since the Second World War, Vietnam, the Philippines, Indonesia, Malaysia, Brunei and other countries began to infringe illegally the legitimate rights and interests of our country in the South China Sea in various forms and advocate for the South China Sea in whole or in part area of "sovereignty",Which is the most arrogant in VietnamVietnam, the Socialist Republic of Vietnam. Located in the eastern part of Indochina Peninsula in Southeast Asia, the territory is long and narrow,S shape.The northern part is connected to Yunnan and Guangxi, the West is connected to Laos and Cambodia. The area is about 330 thousand square kilometers, the eastern part is connected to South China Sea, the coastline is 3260 nautical miles. In 55 islands of Nansha, Vietnam has illegally occupied 29. In addition, Vietnam oil output has reached 8 million tons in the South China Sea, accounting for 27% of Vietnam’s annual oil production of 30 million tons. At the same time, it is also the only one who proposes sovereignty of all the waters of the South China Sea, but also invades and occupies the largest number of islands in South China Sea.However, Vietnam’s policy in the South China Sea is not Invariant, it can be seen as a watershed in 1975, which is at the end of the Vietnam War.It was a transformation of the attitude of the authorities.In previous Vietnam(North Vietnam)the official publication of the history books, maps, books, or diplomatic note were clearly recognize the sovereignty of China in the South China Sea. And with the end of the Vietnam War, Vietnam’s policy in the South China Sea has been changed dramatically. It has changed the previous claims of the sovereignty of the South ChinaSea. In September 1975, the General Secretary of Vietnam communist visited to China.It was the first time to put forward claims to islands in the South China Sea China.In 1979 and 1982, Vietnam announced two of the "sovereign white paper" statement about the South China Sea.After that, the Vietnamese government implemented a series of policies and measures for its so-called "national interests", "to consolidate and expand the" illegal interests of Vietnam in the South China Sea ". In political aspect, they established so called the South China Sea administrative district. In military aspect, they occupy the South China Sea Islands further. In economic aspect, they plundered the South China Sea oil resources. In diplomatic aspect, they draw relevant ASEAN countries to conflict with China. To some extent, it may infringe rights and interests of China in the South China Sea and also damage China’s sovereignty and territorial integrity.The reasons why Vietnam may change their South China Sea’s policy is that not only its geostrategic considerations as well as the coveted the rich n natural resources outside the, but also sensitive political environment by the end of the Vietnam War.Vietnam’s current policy of the South China Sea violates clearly the basic requirements of international law, challenges seriously the bottom line of international law. Especially the behavior of Vietnam invaded islands and reefs in the South China Sea violates "preempt" principles of international law, "succession of States" principle and "no estoppel" a flagrant violation of the principle. China’s current South China Sea Policy should be based on the “sovereignty belongs to me, peaceful coexistence,lay side dispute, common to develop”, the sixteen principles to handle with relationship properly between China and Vietnam. Specifically, the demarcation of the South China Sea on the limits of the continental shelf and the islands territorial sea baseline should be based on the principles of sovereignty belongs to me; accelerate to development to South China Sea should be based on the principles of putting aside disputes; coordination relations with relevant countries in the South China Sea should be based on the principles of peaceful coexistence.
