Study On Public Participation In The NIMBY Decision-making Process

NIMBY is a product of conflicts of rapid urbanization and awakening public awareness of the rights between, with distinct characteristics of the times. Although it can reflect the progress of society in many ways, but its destructive force of urban construction and development of normal is obvious, serious impact on China’s social stability and economic development. Cause NIMBY arising from multiple aspects of economic, political, social ethics, from the perspective of administrative law, NIMBY conflict is essentially reflects the right to participate in public affairs as a public interest demands for urgent.Topic of this paper is to explore how to avoid public participation in decision-making system by designing adjacent to achieve a consensus to aim NIMBY relief to some extent. By studying a series of typical NIMBY event, insufficient to explore the practice of public participation in the event to clarify the concept of NIMBY, that the main core contradictions That is to protect the public interest and part of the special interests of citizens between the sacrifice contradictions, so to resolve this conflict, we must be in the public interest between personal interests and the formation of a coordination and consensus. After the introduction of public participation system, in order to solve the contradiction, what goals the system should be designed to pursue that constitute the functional orientation NIMBY public participation in the decision-making system. Because of the existing system of public participation is mostly for the general or major executive decision-making design itself has many deficiencies, when faced with this particular decision NIMBY executive decision-making, it is stretched, it is difficult to deal with. Therefore, in the last part of the article, the author of the existing public participation law in order, decision making binding NIMBY special requirements of their proper function, the information from the public, participants involved in the opportunity to participate in four important ways put forward a specific program ideas.
