This paper is concerned with foreign NGOs in China who operate in the child welfare sphere. This article attempts to analyze how laws, policies, and legislation, particularly child welfare legislation, has effected how foreign NGOs function in China. Other than the 1989’s Provisional Regulations on the Administration of Foreign Chambers of Commerce and 2004’s Regulations on the Administration of Foundations, foreign NGOs have not officially been brought within the Chinese legal system. In 2009, Yunnan Province introduced the "Provisional Regulations on Regulating the Activities of Foreign NGOs" which was a nationally authorized pilot legislation. These, together with the new Overseas NGO Management Law, are China’s attempt to clarify the laws governing how international NGOs are to function. This paper is a historical view of child welfare policies and NGO legislation that has led up to this Overseas NGO Management Law. We will see some of the impact that international NGOs have had in improving the service delivery to vulnerable children in China. We will analyze whether the new Overseas NGO Management Law can achieve what its stated purpose is in Article 1:"To standardize and guide activities carried out by overseas NGOs within China, to protect their rights and interests, and promote cooperation and exchange between the government and NGOs." Most importantly, we ask whether this law will contribute to meeting the needs of vulnerable children in China and whether it will enhance the profession of social work throughout China.
