Research On The Problems And Countermeasures For County-Level Government To Promote The Mechanism Of Power Lists

The third Plenary Session of the 18th CPC Central Committee has passed Decision of the Central Committee of the Communist Party of China on Major Issues Concerning Comprehensively Deepening reform and clearly put forward "promote the mechanism of power lists in all levels of government and their departments and disclosure the operating process according to the law." So it opened the comprehensive implementation of the mechanism of power lists. Thereafter, the fourth Plenary Session of the 18th CPC Central Committee clearly the significance of promoting the implementation of mechanism of power lists, eliminating rent-seeking space, comprehensively promoting the government publicly for promoting to govern the county by laws; in Mar,2015, the central government has issued Directive Opinions for Promoting the Mechanism of Power Lists in all Levels of the Local Governments and its Working Departments and develop specific requirements of the goal, tasks and organizing the implementation of the full implementation of the mechanism of power lists. The implementation of mechanism of power lists is the key step to comprehensively deepen reform, comprehensively promote the theory of ruling the county in accordance with the law. It is also a new starting for promoting the transformation of government functions, promoting decentralization and building a clean government. Through the implementation of mechanism of power lists, the powers and responsibilities of the government can be open to the public in the form of a list and define the boundary of government power, clear that what the government shall do, what the government shall not do, which powers shall be retain, which powers shall be cancelled or decentralized and so as to clarify the responsibility boundaries of government, market and society.In the process of carrying out the mechanism of power lists, the county-level government is an important link which cannot be ignored. Whether the county-level government can implement the mechanism of power lists has been the "last mile" problem in the implementation of mechanism of power lists. At present, mechanism of power lists is still in the initial stage of implementation, other provinces, cities and counties for the list of power system is still in exploring. If the problems related to the systems, specifications, procedures cannot be solved, the formulation of the mechanism of power lists will stay in the "quantity". It is unable to play its due role. The implementation of the mechanism of power lists and achievement of acting by "list" have a long way to go.This paper adopts method of on-the-spot investigation, comprehensively use methods of literature analysis, individual case analysis, data analysis and interview research, take the limited government theory, service-oriented government theory and the power restriction and supervision theory as the theoretical basis, analysis the problems appearing during the process that county-level government promotes the specific practices and process on the mechanism of power lists and try to explore the effective path for county-level government to implement the mechanism of power lists.This paper is developed mainly from the following four parts:Part I:Introduction. It mainly elaborates the background and the significance of the topic, the domestic and foreign literature research on the mechanism of power lists, the research method, the writing frame and the innovation of this article.Part II:The theory summary for county-level government to promote the mechanism of power lists. Firstly, it outlined the meaning and characteristics of administrative power, the county-level governments and their administrative authority; secondly, it described the meaning of mechanism of power lists and the significance of promoting mechanism of power lists; thirdly, it stated the theoretical basis of the list of mechanism of power lists, mainly include limited government theory, service-oriented government theory and the power restriction and supervision theory.Part Ⅲ:Taking T County as an example to analysis the conditions for county-level government to promote the mechanism of power lists. Firstly, this paper introduces the specific action for T County to implement mechanism of power lists and make comments on its guiding thought and requirement, cleaning basis and scope, institution and division of labor and the specific formulation process; secondly, it analyses characteristics of the T County which has promoted the mechanism of power lists; Thirdly, the paper analyses the results of the T County which has implemented the mechanism of power lists; Finally, it analyses the appeared issues and reasons for the T County to promote the mechanism of power lists.Part Ⅳ:The discussion of the routes for the county-level government to achieve the mechanism of power lists. This part is based on the specific case mentioned above of the T County promote the mechanism of power lists, promote corresponding countermeasures based on the problems:scientifically identify the power and distribute it in accordance with the law, improve the undertake ability of the power by county-level government; "three lists and one net". Create a comprehensive mechanism of power list and build the supervision and management mechanism that the county-level governments promote mechanism of power lists.This paper, based on existing domestic and foreign scholar’s research results strives to be innovative:(1) from the perspective of study, the innovation of this paper is the perspective is county-level government. Put the T County government and its departments as the object of study, induce and integrate the approach, experience and problems and explore how the county-level government establish normative power list making program and the list of powers system implementation model. (2)From the perspective of research methods, the innovation of this paper lies in using data analysis methods, comparative analysis and interviews and other research methods. It summarized the specific practical actions and carry out comparative study with other counties and cities, analysis merits and shortcomings of the various practices. Finally through interviews, in-depth understand the methods and difficulties for county-level government to develop the mechanism of power lists and draws the conclusions:the implementation of mechanism of power lists by county-level governments needs scientific identification of power, distribution of powers in accordance with the law and improve the county government of power ability of undertaking; "three lists and a net", namely to create a comprehensive package of mechanism of power lists; combining the release and management can establish supervision and management mechanism that the county-level governments promote mechanism of power lists.
