The Study On The Law Question About The Work That Putting The Files On Records For Future Review Of Local People’s Congress Standing Committee

After supervision law of the People’s Republic of China was passed, the standing committee of the local people’s congress began to develop the local rules and regulations of regulatory documents for the record review. In the practical work of the standing committee of the local record review, they carried out the record review seriously and actively. But time of local record review system setting up is short, the experience of the record review work is still in groping stage, which still belongs to the weak segment of supervision work, and the system still exists many defects and deficiencies. At the same time, discussion and consideration of theory of local people’s congress standing committee for the record is insufficient now, and the related theory hasn’t careful thinking and can’t solve many problems in practice. So the supervision function of Local Standing Committee of the People’s Congress can’t play effectively. Therefore, based on the above reasons, this article attempts to begin from the basic theory of the record review, on the meaning of the record review, legal basis and significance, theoretical foundation and resource development. Then pointing to the local’s record in recent years, it summarizes, analyses and rethinks about the review local laws. This article tries to think and analyze about several aspects which expands the scope of the record review, integrates the record, censorship, unifies examination standard, improves procedure of review start up and review mechanism, to enrich the record review system.
