Research On The Trade Secret Protection Of The State-owned Steel Enterprises And Improvement Suggestions

State-owned steel enterprises belong to the basic material manufacturing industry. For a long time,they are the important pillar of the national economy in China and stand at the forefront of the competition in the world, especially the central enterprises among them. So the intellectual property advantages of the State-owned steel enterprises deeply affect our country’s international competitiveness.Trade secret is the intangible and most valuable asset and contains huge economic interests and core competitiveness of an enterprise. In recent years, the State-owned steel enterprises in China, especially the central enterprises pay more attention to the protection of patents, trademarks and Copyrights but insufficient attention to trade secret protection compared with some developed countries. However, trade secrets was cited as the top intellectual property(IP) concern in the US-China Business Council’s(USCBC) 2012 member company survey. And under the background of China’s innovation-driven strategy, trade secret protection will become the most important branch of the intellectual property protection for State-owned enterprises. Enterprises can better protect trade secrets by implementing best practices for prevention and enforcement.So the dissertation consists of three consecutive parts. The first part explores the definition of trade secret: technical or business information that are not known to the public and have economic benefits for the rights holder.After describing and analyzing the component of trade secret, the second part seeks to the legal attribute of it base on the Agreement On Trade-related Aspects of Intellectual Property Right(TRIPS) articles.In the third part of the dissertation, I do some research on the problems caused or faced by the State-owned steel enterprises in the management and protection of trade secrets, mainly including the problem of coping with the management system of the scientific and technological achievements, dealing with the relationship between state secrets and trade secrets, and the protection of trade secrets under the big data and cloud computing. After that, giving some practical improvement suggestions to deal with the problems above.
