Research On The Duty Crime Of "Rural Cadres"

In recent years, with the rapid development of rural urbanization, plenty of social fund, resources’ pouring into rural areas, the rural cadres’ duties have been increased. Because the rural cadres aren’t managed efficiently, there have been more and more duty crime cases among the rural cadres, which has influenced and restricted the development of national economy and rural stability. "Small village big corruption" has been worthy of attention in the stage of China’s reform and development. Identifying the rural cadres’ identity, defining their scope and controlling duty crimes have become one of the important research topics.Based on analyzing the investigation of different kinds duty crime cases in Guangzhou, summarizing and analyzing the present situation and characteristics of the duty crimes, this paper possesses quite significant sense in both theory and realism. At present, the duty crimes have severe situation because of different reasons. There are several object reasons. One is that the criminal legislation in our country doesn’t define the nature and status of village cadres, which has caused weak law enforcement. One more is the negative effect of market economy and the influence of social decay thought. Another is that supervision and management system is not perfect, which leads to power rent-seeking. There are subjective factors as well, for example, the rural cadres lack political belief, they have consciousness of the rule of law and some abnormal psychology. Therefore,according to the rural cadres duty crime characteristics and the high incidence of reasons, it is suggested that from the aspects of ideological education, system perfection, strengthening supervision, promoting the rule of law, strengthening the punishment, etc., we should build the village official duty crime prevention mechanism so that we can promote the rural cadres duty crime punishment,prevention, safeguard the vital interests of the villagers, and promote rural reform,stability and development.
