The Research In The Protection Immigration Policemen’s Law Enforcement Interests

In recent years, as China Immigration Inspection(CII) improve its service level and further promote the construction of law enforcement standardization, the enforcement activities of CII gradually incorporated into the track of standardization and legislation, greatly promote the quality of enforcing the immigration law and serving the people improved significantly, the satisfaction of social public to CII continue to improve. But at same time, some negative appearances can not be ignored in the activities of CII. Such as, the torts of immigration police is the most deserve attentions and discuss appearances. Return to the subject of this article which is through the study of the reasons of immigration police violation cases and measures of safeguarding the legitimate rights of immigration police to provide some references for the safeguarding of legitimate rights for all institution of CII.The legitimate rights violation events occurred around the immigration police as a starting point of this article, according to the analysis of various aspects of the rights safeguarding case of immigration police, and compare to domestic and overseas in the right protection of public officials, in order to come up with the countermeasures and suggestions in how to strengthen right-protection of immigration police during their law enforcement work.This article is made up of five chapters:The first chapter is the introduction, which mainly introduces the background of the research, the research status from domestic and overseas, the significance and method of the research.The second chapter is the analysis of current situation of right protection during immigration police enforcing the law, analyzing and reviewing the historical evolution of the immigration police law enforcement efforts and the right protection problems encountered by Guangzhou immigration police during their law enforcement work.The third chapter is the analysis of reasons of immigration police rights and interests infringement durning enforcing the law.Mainly from the aspects below,lack of deterrence of the current law, negative guidance of the public opinion, the contradiction between the social improvement and the occupational characteristics,the difficulty in collecting evidence after infringement act,weak right-protection awareness of immigration police.The fourth chapter is the analysis of other police departments from domestic and overseas on the protection of rights and interests while executing the law, in order to bring enlightenment to the right-protection issue of immigration police’s law enforcement work.The fifth chapter is the countermeasures and suggestions of improving protection of rights and interests of immigration police’s law enforcement work, suggesting that the right-protection should proceed from two aspects, one is legislative perfection and improving external environment, the other is improving the system of right-protection and arousing the awareness of right-protection.In the end, the main conclusion of this article is summarized as well as the shortcoming of the research.
