| Judge is the main role in judicial activities. The reform of judicial system for specified number of personnel is an essential component in Chinese judicial system reform, the result of whose reform is of vital importance for judge specialization. The major problems in Chinese judge group embody in four aspects, that is, the non-elitism of judge’s recruitment, the administrative-orientation in judge management, the non-judgeship in judge composition and unreasonable allocation of judge’s work. With the development of China’s judicial reform and the appearance of central governmental documents such as Several framework-based views on problems in experimental areas of judicial reform and The work program for Shanghai experimental judicial reform, experimental courts have undergone several trials in judicial system for specified number of personnel. Despite the successes those courts have achieved, they still have obstacles to overcame.This paper first introduces the background, the necessity and the significance of judicial system for specified number of personnel. Next, this paper makes clear the situation of judicial system for specified number of personnel so far, for example, determining judge personnel ratio, constructing legal case coefficient which can reasonably calculate judge’s workload, creating judge retirement system and conditional postpone in their pension application and claiming. Furthermore, this thesis puts forward problems in judicial reform, including the restriction for judge’s independence, the mismatching in judge’s rights, responsibilities and benefits and the absence of legal case division system etc. At last, this thesis puts forward according suggestions for improvement in this regard such as contributing to the separation of the court and judge, clarifying laws and rules, deepening judicial system for specified number of personnel, perfecting guarantee system for judge specialization and completing case division mechanism. |
