Research On The System For Specified Number Of Personnel Of Grassroots Procuratorial Organs In China From The Perspective Of Judicial Reform

In November 12,2013,the Communist Party of China in the third Plenary Session of the 18 th CPC Central Committee through the "CPC Central Committee on deepening reform of the overall number of major issues" made it clear that Judicial reform is one of the key focus of the comprehensive deepening of reform.To reform the judicial management system,sound jucicial power operating mechanism.In October 23,2014,the fourth Plenary Session of the 18 th CPC Central Committee by "on a number of major issues comprehensively promote the rule of law decision".January 21,2015 to 22,the Supreme People's Procuratorate held a national conference of attorneys,clear to push forward the judicial reform and judicial reform,efforts to solve deep-seated problems of judicial justice and judicial capacity constraints.In February 2015,the Supreme People's Procuratorate issued "on deepening reform of procuratorial opinions(2013-2017 work plan)"(2015 Edition),under the new situation of the comprehensive deepening procuratorial reform deployment,clearly put forward: establish the system of prosecutors officials,estabilish the professional position sequence of the prosecutor and relative wage system.Improve public prosecutor's professional access.But the full implementation of the pilot and in the process,especially the prosecutor post system and promote the case responsibility tenure clearly,because ensure the corresponding system has not been established,the prosecutor in the amount of incorrect treatment,condition is not completely clear,and because of differences in case detection and observation functions are too broad and other issues,leading to different area of staff turnover,remiss performance situation.This paper attempts to combine empirical research and comparative analysis,in-depth analysis of procuratorial staffing system features in the design of the system,combined with the actual work of the procuratorial organs,procuratorial organs from outside the post system experience,puts forward suggestions for further improvement of the procuratorial organs under the judicial reform of the personnel system.
