The Third Plenary Session of The 18 th CPC Central Committee confirms the task of promoting the China nomocracy establishment and the judicial system reform.The main reform method is: Focus on the aim that let every Chinese people feel to be fairly and honestly treated in every case;Ensure that the people's courts will exercise their judicial power independently and impartially and continuously improve the judicial credibility;Promote the modernization of China's government system and administration ability.Now,under the guidance of the reform of top-level judicial systems,China finally starts the judge system reform--to specify the judge number.The judge system for specified number of personnel is a system trying to establish professional,elite judge team.As a basic and key system in the deepening of judicial system reform,the advantages of the judge system for specified number of personnel become more and more obvious in every judicial system reform.The largest value of the judge system for specified number of personnel is that it can ensure that the truly outstanding judges can work for the judicial cases and to improve the judge quality and effect from the source,which can improve the judicial authority and judicial credibility so as to finally achieve the ultimate value pursuit of realizing the judicial fairness and honest.And,the key precondition to ensure the successful implementation of the system is to establish scientific theory foundation,value pursuit,function positioning and system frame related with the specified judge number system.In the essay,firstly,the general introduction is given,and then the opinions are expressed in the following parts: In the first part,the theory foundation and institutional logic are illuminated.It emphasizes the theory foundation,presuppositions and institutional logic related with the judge system for specified number of personnel reform,which provides the legitimacy foundation and theory source for the following discussion.In the second part,the investigation of the implementation situation of the specified judge number system.It analyzes the problems and difficulties met by the judge system for specified number of personnel reform by collecting the reform data of different trial courts and analyzing the current situation of judge system for specified number of personnelIn the third part,the theory and practice reflection of the reform of the judge system for specified number of personnel is mentioned.By combing with the problems existing in the practice,the theory reflection about the judge system for specified number of personnel is mentioned in the essay so as to find the root cause of the problems,which lays foundation for the proposing of the corresponding actions and suggestions in the following essay.In the fourth part,the practical paths of the establishment of the judge system for specified number of personnel is introduced.It puts forward corresponding solutions and suggestions for the judge personnel's classification management,the ranking of court positions,the judge allocation proportion,judge employment standards and so on.It mainly discusses the judge incentive and restraint mechanism and related suggestions.
