On The Community Correction For Juvenile Delinquents

With the idea of the doctrine of severe punishment changing, it is acknowledged that more attention to fighting crime while less attention to preventing crime cannot effectively avoid crime. And given emerging disadvantages of mode of imprisonment penalty, the government has begun to reflect on the correction pattern subjected to the traditional concept, so that the community correction of non-confinement penalty execution mode arises at the historic moment. Minor refers to 14 to 18-year-old teenagers. Being in adolescence, they begin to abandon childhood thinking gradually and transit to an adult one, during which the minors’ outlook on life, the values are changing. Therefore, juvenile offenders tend to be remolded more easily than adult criminals and in more need of community correction as the former group depends more on their families, friends as well as the environment they know. The implementation of community correction for juvenile criminals is also based on the traits of the juvenile offenders and the special requirements of the modification for itself.Currently, the implementation of the community correction for juvenile criminals is based on the related laws and regulations as well as detailed rules for enforcement from place to place. Accordingly, the building-up of working mechanism for the community correction system, sort management, development of professional personnel and the practical implementation can vividly demonstrate how this practice works. Efforts should be made to look into the stipulation and the implementation of the regulation of community correction for minor offenders. And various problems are indeed detected, which are well presented in this paper. Firstly, the indiscrimination can be found between juvenile offenders and adult offenders in terms of contents for community correction. Juvenile offenders, plagued by ill confidential system will end up with the same reeducation and social service as adult criminals. Secondly, there is a great shortage of build professional teams aiming at the community correction of minor offenders. Thirdly, absent is the variety of correction projects as the proper correction projects considering features of juvenile delinquency are yet adopted. Fourthly, it’s hard to find tailed correction programs in view of the characteristics of minor offenders instead of adult criminals.Based on national conditions of China while looking into the community correction for juvenile delinquents in other places, the author proposes the following suggestions, namely, to highlight the investigation and evaluation system before trail before implementing community correction in a scientific manner, to improve the legislative system for the community correction for minor offenders, to increase or decrease the time for reeducation or social service accordingly while choosing proper way of service with sound confidential system, to build professional teams aiming at the community correction of minor offenders when staff from judicial authorities work as the major managers and supervisors while community workers for community correction as primary executors, to enhance community workers’ ability and increase their income, to bring in talents as volunteers being the support personnel, to adopt proper correction methods in the light of traits of juvenile delinquents with suitable psychological guidance and sound education of legal system as well as technical and vocational training, to introduce correction projects in the light of traits of juvenile delinquents such as parental education, home confinement and appalling probation. This research combines theories and practice hoping to offer effective suggestions for China’s community correction of minor offenders and valuable references for the executors of community correction.
