The Research On The Altering Of Custody Of Juveniles

At present, divorce is a very common phenomenon in our country. All kinds of disputes derived from divorce dissension are on the rise too, in which Alternation of Child Support Right takes a very big share. To juveniles involved in such cases, the divorce of their parents is a fact, improper disposal of the juveniles support right dispute would probably means a second chance of harm. Meanwhile, the juveniles support right dispute relates to juveniles’ benefits, such as growing, living, and studying environment. This problem has draw more and more attention in our community.Based on the S District of W City Court trial custody dispute empirical investigation, analysis of legislation and judicial practice deal with such disputes operational problems faced.The main body of this paper consists of three parts. The first part of the research topic clearly explain "custody" This article discusses the meaning of the core concepts,and describes the overall situation of the study sample. The second part is the empirical research on the reason of alternation of Child Support Right, litigant’s judicial act and the judgment tendency of the judge, using statistical method and case analysis to study Alternation of Child Support Right Disputes.The third part gives advises on Alternation of Child Support Right Disputes from both the lawmaking and judicature aspects, namely establishing the parental right system, adopting the double structure of custody and parental right, perfecting lawmaking in concern, adding feasible terms for the best interest of children, weakening the litigant’s will autonomy,increasing judicial procedure involvement. When handling the Alternation of Juveniles Support Right Disputes, law officer should keep pace with the times,converting from the parental standard to the children standard.
