Legal Countermeasures Research Of Punishing Xinjiang’s Criminal Terrorist Activity

For a long time, as a domestic terrorism frontier and main battlefield, Xinjiang has faced a severe anti-terrorism situation. Especially in recent years, inside and outside violence and terrorist forces, religious extremism, ethnic separatist forces entered a new active period, which has planned and implemented more events of vicious terrorist crimes, which leading to serious harm of national security, public safety, safety of people’s lives and property. To combat and punish terrorist crimes effectively, the legislature has formulated the "Criminal Law Amendment(IX)" and "Anti-Terrorism Act." in succession. However, the implementation time is shorter, concrete results remains to be tested. Since the working process of anti-terrorism legislation is lagging behind, resulting in a passive situation in combating terrorist activities and crime in Xinjiang.There are some problems and deficiencies. On this basis, based on the criminal field, combined with current legislation and judicial practice, this paper explored legal measure against terrorism offenses, which is divided into four parts.Introduction. It was introduced briefly to research background, purpose, status and methods.Chapter one is a situation overview of Xinjiang’s terrorist offenses. In the first section, by inspecting the crime purpose, means, object, subject of terrorist activities in Xinjiang, it was explained the concept of Xinjiang’s terrorist offenses. In the second section, it was briefly summarized the current situation in Xinjiang’s terrorist crime. In the third section, it was briefly described the main features of Xinjiang’s terrorist offenses. In the fourth section, it was mainly based on different criminal means. Xinjiang terrorist activities and violent crimes were divided into two categories of violent and non-violent. Violent terrorist activities and crime groups were divided and the types of non-violent terrorist activities and crime were classified. In the fifth section, it was outlined real factors of Xinjiang’s terrorist activities and crime generated.Chapter two is legal analysis in punishment of Xinjiang’s terrorist activities and crime.Chapter one is mainly combed on the specific provisions of the Criminal Law, Criminal Procedure Law on terrorist activities and crime, which pointed out the shortcomings which existed from the substantive and procedural aspects. Chapter two is mainly combined with judicial practice of Xinjiang judicial authorities handled terrorist activities and crime cases, pointed out twodifficulties present therein. The first is the problem of defining terrorism crime and general crime;the second is the problem of identifying in terrorist organization and its personnel.Chapter three is Legal Countermeasure of punishment of Terrorist Activities Crimes. Through the aspect of complementing criminal law, criminal law Interpretation, accelerating the construction of the local anti-terrorism legislation, strengthening international cooperation against terrorism and prevention governance of terrorist activities, it was investigated the legal measures against terrorist crimes.
