Abstract/Summary:
R.C. Hingorani is a renowned international jurist in contemporary India and was active in the middle and late period of last century. His main research field is human rights and humanitarian law. His academic works in the field of the international law attracted much attention and won good reputation in Europe and the United States and as an expert in human rights and humanitarian law, he enjoys a certain reputation in the field of international law in Western. At the same time, as an international law professor from developing countries, R.C. Hingorani has been working to reflect the developing countries’ law opinions and requirements and tying to maintain the voice of the third world politics and economy by his own works. He has a considerable influence in India, Asia and the third world. R.C. Hingorani’s academic thoughts focus on three areas. The first area is the meta-problem of the international law. His representative view is the query about the traditionally accepted concept, the modern international law originated from modern western. He denies Grau Huges’ s status of "the father of international law". He gives recognition to the international law and opposes to the appearance of "civilized countries" in the definition of international law; His second research area is human rights and humanitarian law. He believes that the realization and maintenance of human rights depends on judicial protection and human rights should be synchronized with the development of democracy. He approves humanitarian law and calls for a more comprehensive way to spread and practice. He opposes to interfere in other countries’ affairs by reason of human rights and humanitarian; His third research area is the application of international law. He expresses his views on the basis of the idea that India national interests above all else and the economic and political rights and interests of the third world countries should be maintained. Thus, he has been paying the attention by its efforts to safeguard the rights and interests of developing countries, but in the Kashmir dispute and the Sino Indian territorial dispute he has shown a very narrow nationalism. In addition, R.C. Hingorani applies a modified and "metaphor" method in his academic writings. His deliberate choice skills show a distorted view of his cognitive and value via his attitude and emotion, making his academic thought a contradictory body. R.C. Hingorani academic thoughts reflect the potential impact of the "position" factors on the international scholars’ distress of exploring historical truth and the impact of discipline development, political and environmental factors on law scholars’ thoughts.
