With economic development, especially the development of economic globalization, people increasingly rely on energy demand and strong. Therefore, the search for alternative energy, clean, recyclable, high economic efficiency of new energy has become the top priority of the various national energy strategy. New Energy with freshmen, and inevitably require government support, but often the main form of subsidies. Outbreak of the financial crisis, so that each sought to relieve the country’s foreign channels, often expressed as a set of non-tariff trade barriers to protect domestic industries stealth development in order to ease the contradiction between the various sectors of the country. The use of new energy subsidy policies more and more. Country became the second most trade remedy objects. The use of new energy subsidies and countervailing measures often rely on policy guidance, strong political bias, this phenomenon is the distortion of the energy mix. Therefore, this paper new energy subsidies this perspective that seeks to improve the subsidy system. In this paper, a method of comparative analysis, comparing China and Europe subsidy policy, which leads to new energy law and policy of subsidies, in order to improve China’s new energy subsidies legal system. There are four main parts: Part I: Introduction What is the main subsidy, and what is new energy subsidies and its necessity. Subsidies and Countervailing law and our policies in the new field of energy were discussed. Leads to the second part: China’s new energy subsidy problems in the legal system. Part III: Summary of the legal system of the new energy subsidies abroad for analysis. The fourth part by the previous comparison, concrete solutions to problems raised.In conclusion, the study of new energy subsidies legal system conducive to provide protection for our energy security, more conducive to trade remedies in the country in response to changes in passive attitude, strengthen the system of legal regulation of subsidies to reduce political, in order to adapt to the WTO trade requested relief mechanisms.
