Study On The Implementation Of The "Marriage Law" In Chongqing Area In The Early Days Of The Founding Of PRC(1950-1956)

In May 1950, “Marriage Law the People’s Republic of China “promulgated and implemented, the Chongqing area combined with its own history, has made great success in the implementation of the "marriage law". During the implementation process of "marriage law" in Chongqing area, due to the many problems of thinking and understanding between the implementer and the masses, such as misunderstanding, comics and so on, under the interaction of these reasons, the deviation appeared. Along with the implementation of the "marriage law", the abnormal state of marital status began. The work methods and corrective measures in the implementation, adopted by the CPC, also have important reference and inspiration to the party’s work new in the new period. Through the analysis of files and journals, this paper tries to return this period of history, to clarify the real mental process of the different district people, during the implementation of "marriage law" in Chongqing area, and the deviation of the original policy when the "marriage law" is implemented at the grassroots level, and the original history situation of the timely rectification. Then there comes to the following points: first, the implementation of the policy should be done by a variety of means, through the single administrative means, top-down and mandatory implementation is not feasible. Second, in the implementing of process, deviation should be practical and realistic. Third, the promulgation and implementation of laws and regulations should be a routine work.In this paper, the logic structure is composed of the introduction and the main body.The introduction discusses the reason and significance of the topic, and makes a review of the current research situation of this topic, and also determines the research ideas and methods of this paper, and defines the relevant concepts.The first part: the original intention of the "marriage law" in the early days of the founding of the PRC and the marital status of the Chongqing area. The second part: the phenomenon of "divorce tide" in the implementation of the "marriage law" in the early days of the founding of the PRC in Chongqing. This part mainly discusses the two aspects of the "divorce tide" in Chongqing, the time and the form. The third part: the cognition and behavior of the parties to the marriage law. The fourth part: the ordinary people’s attitude to the "marriage law" the implementation, indifference and acceptance. This part focuses on the analysis of the psychological changes on the ordinary people in learning the "marriage law" before and after, from indifference to accept. The fifth part: Cadres’ attitude to the implementation of the "marriage law", it mainly analyzes from three aspects: concerns on the administrative cadres, the negative resistance on the grassroots cadres and the contradiction of “love and law” on the judicial practitioners cadres. Sixth part: in the early stage of the founding, the thinking on the deviation phenomenon during the implementation of the "marriage law" in Chongqing area. Through the front several parts exposition of the "marriage law" in Chongqing at the early period of new China, the paper, from the improvement of social customs, the development of productivity and improve the political identification of the Communist Party of China’s, makes a beneficial thinking, which provides a useful lesson for the smooth development of the work of new period party.
