The Comparison Research Of Religious Management Legislation Between China And Kazakhstan

Religion is a certain historical stages of a cultural phenomenon of development the human society, in the field of consciousness, the impact of religion on human society cannot be ignored. With the development of global integration,Communication of religious culture between the Chinese religious community and the world of religious groups are frequently increasing, in such a complex situation, a variety of problems are worth our thinking. Because the Chinese religious management legislation system is still not perfect, and the lack of a unified legal system to regulate the management of Religious Affairs, therefore, Problems and Countermeasures in the legislation of religious management need to do further research and discussion. Domestic religious issues and characteristics in Kazakhstan,which adjacent to China, have some similarities to China, its religious legal system is relatively mature and perfect, the religion legal system of Kazakhstan has a very important reference value for Chinese religion legislation.The research object of the religious administration law, four parts are described in this paper. First, the formation, current situation and characteristics of the nationality and religion between China and Kazakhstan are discussed. Secondly, The historical origin, legislative changes and development of the legislation of the religious management of the two countries, as well as the development and legal system of the two countries are summarized. Then, did comparison and research on five aspects of the provisions of the relationship between politics and religion in religion legislation, religious belief, religious groups and religious activities and using religion to commit crimes and penalties between two countries in the third part,summarizes the Chinese deficiencies in the legislative aspect of religious management.At last, put forward the idea and suggestion for the construction of the religious legal system suitable for Chinese national conditions based on the Chinese religion management legislation.
