| Occupational safety and health labor cooperation is a new thing in China. The content related to the labor cooperation is less in our country. Compared with western developed countries, the issues about legal protection of our country’s occupational safety and health law still have much improvement space. This paper is to discuss the current situation of the occupational safety and health labor cooperation in our country by using the method such as comparative analysis, empirical analysis and so on, basing on a large number of relevant laws and regulations. Legislative regulations on occupational safety and health cooperation subject and the legislation on occupational safety and health of the specific form of collaboration between labor regulations are the parts of the current situation, which pointed out the problems about the labor cooperation. For example, our country labor cooperation of occupational health and safety has the legislation guiding ideology. The unsound legislation content of larger and operability is not strong. Many loopholes and the shortage of occupational safety and health law responsibility are also the problems. By drawing from Anglo-American countries advanced legislative experience and improving labor cooperation framework of the law system of occupational safety and health in China,set the specific mechanism of labor cooperation and the appropriate punishment mechanism. Punish the destruction of occupational safety and health labor cooperation harsh. Make encouraging economic policy to encourage both sides of labor and capital cooperation in the field of occupational safety and health. Select pilot enterprises, and promote the occupational safety and health of collaboration actively between labor and so on. |
