Research On The Optimization Of Education Administrative Law Enforcement In Quanzhou City

Educational administrative law enforcement is an important part of the administrative law enforcement, strengthen the study of education enforcement, carry out educational administrative law enforcement system reform is the inevitable requirement that education carry out the spirit of the Third Plenary Session of the eighth, build the rule of law government and service-oriented government, also is an effective way to the education department changing functions, administration by law and breaking the current outstanding problems of education management facing. But at present, the development of education administration law enforcement and legal system construction still have a great distance, law enforcement ability is poor, the law enforcement is not standardized, resulting in the education of administrative law enforcement and specific education management practice asymmetry, education laws and regulations can not reflect its due authority.This paper uses the theories of educational administration and the administrative law theory to study on the education administration law enforcement in Quanzhou. The paper based on the analysis of statistical data of Quanzhou education development and field survey data, using the literature analysis, survey, interviews, case analysis and other research methods comb the subject, basis, procedure and authority of Quanzhou educational administrative law enforcement. Summarize the education administrative law enforcement of Quanzhou city is facing the lack of awareness and ideas of law,existing administrative thinking inertia,education administrative law enforcement mechanism is not perfect,law enforcement responsibility system is not implemented, education administrative law enforcement is not strict, education administrative law enforcement is weak and the other new situation and new problems, and analyze their causes. The article concludes, Quanzhou education administrative law enforcement can learn the experience of education administrative law enforcement from American and other prefecture level cities in China, by strengthening education reform of administrative law enforcement system,establishing the concept of the rule of law, improve the ability of the administrative law enforcement officers, clear educational administration permission law enforcement functions and other optimization suggestions, to promote the legal norms of educational administrative law enforcement, and effectively ensure the implementation of educational laws and regulations, in order to provide a means and reference method for the education and managemen.
