As China’s rural economic and social development important basis and the rural education work strategic focus, the rural vocational education play a huge role in vocational and technical education for farmers and vocational training, and rural labor transfer. To develop the rural vocational education will plays a good effect for the effective transfer of rural surplus labor, to solve the problems of "agriculture, countryside and farmers", effectively promoting urban and rural development. Into the new century, along with the national long-term education reform and development plan for (2010-2020) release, the rural vocational education development of the country has been put on the national important agenda, at present our country the whole professional education laws and regulations construction (including rural vocational education) very lag and related laws have been in short supply, in reality, many of the law shall be in carries on the standard content is often shown as a series of policy, so it can’t adapt to vocational education in the rural area fast development, and can’t satisfied the needs of the development of rural vocational education. At the same time, it also against legalization tendency of the world professional education.For that reason, this paper will be how to realize the education fair, promotes the rural vocational education legalization for the research angle, analysis of China’s rural vocational education legal system construction, legal system present situation and major problems in the process. In the related on the basis of analysis of our country rural vocational education legislation of present, thinking about how to build a good operation environment to rural vocational education from law level aspects. Finally, in conjunction with the relevant analysis results, reference to the U.S., Japan, Germany and other developed countries in the professional education legislation in successful experience, puts forward some tentative suggestions for to establish law and regulations security system in vocational education, this security system should be adapted to China’s rural vocational education development.
