Research On The Protection Of Rights And Interests Of Left-behind Children In Rural China

Since the1980s, China’s rural surplus labor started to transfer to city, it has been a backbone of power to pull the urban and rural social and economic development in our country. But our unique "urban and rural dual economic system" is associated with the household registration system, making hundreds of millions of rural migrant workers can only be "urban and rural amphibious", thus produced the huge rural left-behind children, this problem has caused wide concern of the whole society. This article is based on the research of the scholars, from the perspective of human rights, the rights of rural left-behind children’s rights protection in China as starting point, profound analysis the rights of survival, development, protection and participation rural left-behind children from a macro perspective, and summarizes the legal countermeasures to solve the problem.This article mainly from the following several aspects, first of all, we must have a real sense of understanding of the concept of left-behind children in rural areas in China. That is to make a clearly defined of our country’s rural left-behind children, which must pay attention to distinguish with city left-behind children in our country, at the same time, analyzing China’s rural left-behind children from the characteristics and reasons,the cause analysis including both historical and realistic reasons. Secondly, to sum up the various rights endowed by law what China’s rural left-behind children should enjoy combined with the United Nations convention on the international children’s rights and the minor protection law in our country.Then analyze the current practice to protect the rights and interests of rural left-behind children in China besed on the situation and existing problems in detailed.Finally, put forward my own views or measures in view of the present situation and the problems. The focus in this paper is combined with the United Nations convention on the international children’s rights and China’s minor’s protection law and relevant laws and regulations. The mainly research is "four rights" of rural left-behind children in China, the right to survival, development, protection and participation. Difficulty is aimed at present situation and the problems put forward countermeasures. Difficulty is that put forward the corresponding legal countermeasures in view of the current situation and existing problems, in order to solve the problem of rural left-behind children’s rights protection in reality to provide reference basis.
