Study On The System Of Community Correction For Juvenile Offenders

Since a long time ago, juvenile delinquency is an important field of reserch toevery nation’s criminal law scholars. Lenient pulishment and human transformationbecome the development trend of the nation juvenile criminal law. In many countryunder the rule of law, community corrections is the primary means of execution ofpulishment to juvenile offenders, and make difference between juvenile offenders’scommunity corrections and adult offenders’s community corrections. But in ourcountry, with community corrections to full implementation, the special nature ofjuvenile offenders are not considered, and the community corrections generallycontains the juvenile offenders’s community corrections. The problmem is that thecorrective action is unsuitable, and the correction project is not according with thephysical and mental condition of juvenile offenders. The effect was not good.On theone hand, studying juvenile offenders’s community corrections can give juveniledelinquency better education and reformence,making them understanding their crimesand corrections.On the other hand, it can promote the study of juvenile delinquencyand improve our juvenile offenders’s community corrections legislation, and canprevent and control juvenile crime. To respect and protect the rights of minors, thestarting point of this study is to keep the physical and mental health of the juvenileoffenders, create the futre and increase social and public safety factor, and to promotesocial harmory and stability.On the basis of our juvenile offenders communitycorrections system, this paper adopts the method of empirical analysis, to identify theinnstitutional deficiencies,and to inpromte the juvenile offenders communitycorrections system.This article is divided into a total of four part.The first part mainly elaborats the concept and characteristics of communitycorrections of juvenile offenders. This part makes differences between juvenileoffenders’s community corrections and community corrections of adult offenders,anddifferences between community corrections of foreign juvenile offender and ourcountry’s juvenile offender’s community corrections. And analysis it’s characteristics.The second part mainly discusses the basis of theory and reality. The basis oftheory includes the humannitarian spirit of the penalty, the theory of culturecommunication and different communication,and the advantage of community corrections. Basis in reality incldes juvenile crime situation, some country’s juvenilecriminal legislation and judicial practice, and experiences of juvenile offender’scommunity corrections at home and abord. Total to discussing the necessity andfeasibility of the juvenile offender’s community corrections.The third part mainly explains legislative provisions and practice situation of ourcountry’s juvenile offender’s community corrections, and analyzes the legislativedefects, such as the promble of the principle, scope of corrective measures,correcrional institutions and correction officer.The fourth part mainly talks about the legislative proposals.The legislativeproposals specifically includes the establishment of the principle of juvenileoffender’s community corrections, expanding the scope of correction object,specializing correctional institutions and officer, enriching the corrective measures,and seting up joint governance mechanisms and Elimination of Criminal Record.
