Educational discipline has been a hot problem which attracts a lot of focus from the public, and also an unavoidable practical problem in the management of teaching activities in schools and teachers. In compulsory education, although as an effective way of teaching management, educational discipline is also controversial and be placed on the cusp.For students, educational discipline is a "malignant" external element applied in the process of education. Improper exercise will present adverse impact on students, thus the right way to implement this discipline are strictly required for teachers. The key of disciplinary effect evaluation, lies in the effect and appropriateness of teacher’s master of the right of discretion in the implementation process. Educational discipline is a dynamic operating mechanism. As a dynamic, multi-stage operation mechanism, educational discipline contains fact-finding, judgment of the plot seriousness, implementation mode selection and other steps. In this dynamic process, teachers are actual operators in educational discipline implementation and have been playing multiple and integral roles in the specific operation. In violation fact-finding, judgment of the plot seriousness, teachers play the roles of judges, while in the selection of disciplinary approach and implementation time and place, they play the roles of executors. All roles require the teachers to be initiative, to analyze specific issues, which is actually the requirement and presentation of teacher discretion. Based on this, teacher discretion in educational discipline has been systematically studied in this thesis.Introduction part is an overview of the thesis, including reasons for topic selection, research purpose and content, literature review, definition of the core concepts and researching ideas and methods. Chapter One, Two and Three build the theoretical basis of this thesis. Chapter One is the analysis for the presence context of teacher discretion, namely, educational discipline. On the basis of the clearness of its content, the concept will be interpreted on pragmatics and philosophy levels. The following part is the classification of educational discipline, and the law property of educational discipline is defined as "an internal administrative act legally authorized to the administrative body." The second chapter is the discussion on teacher discretion. Through the perspective of jurisprudence, analyzing the legitimacy of its existence, and revealing the dual legal properties of powers and rights in teacher discretion. Chapter Three constructed the basic principles of teacher discretion implementation, including principles of education, legitimacy and relief etc.Chapter Four and Five construct the empirical research of this article. In Chapter Four, through interviews and case studies, the real existence of teacher discretion is demonstrated in educational discipline. While in Chapter Five, as the major topic, problems exposed in the process of teacher discretion implementation is deeply discussed. The presentation of teacher discretion anomie is interpreted at first, including: invalid disciplinary and improper disciplinary. The reasons for anomie acts are also explored and summarized.Chapter Six is the part of countermeasures. In this chapter, based on the starting points of the legislative norms, combination of management and human rights, checks and balances and diverse supervision models, specify the reasonable, legitimate exercise of teacher discretion, thus truly reveal the value of educational discipline.
