Research NPM Of Private Universities In China Debt Dispute

As the development of marked-oriented economy, in China, private education has been rising since the implementation of the reform and opening-up policy. And as a part of higher education, private collage plays an important role to accelerate the development of Chinese education. The rise and development of private collage gradually changed the situation of education from government-owned into government-oriented and joined by all sectors of society. The problem of private collage is more outstanding, as per its social tendency. In recent years, the issues of debt disputes of private collage are occurred more frequently, the results of these problems are the careless of the investors, the unemployment of the students and crisis of the collages. However, as the nature of private education is different from others’public interests, risks resulted from debt disputes are not affordable. Hence it is necessary to prevent it and avoid the risk for consistent and stable development.By collecting and analyzing a large number of relevant cases, we found the current debt disputes of private universities were caused by the negligence of one main party.Based on this clue, this article was written from the perspective of the debt disputes in private universities and divided into four categories: the debt dispute of Private universities between financial institutions, investors, dents and teachers. By analyzing the samples of relevant cases, we found the causes of the current debt disputes in private universities were the diversity of debtors, the violations of rights, the negligence of debtor and the complexity of factors. By analyzing the current debt disputes in private universities, and combing with the analysis of the relevant China policies and regulations, the reasons why the debt disputes happened frequently can be classified into three categories:First, incompletion of the China relevant policies and regulations, such as the relevant provisions are not clear; the related policies are lagging behind; the relations of properties are unclear; the return systems are uncertain and etc. Second, poor of the internal university management, such as the educational philosophy of the investors are deviating; manager’s awareness of the law is weak; the complexity of the internal universities properties, financial management and students’ recruitments; the low quality of student education and etc.Third, lack of responsibility of the government and its departments, including the uncertain of the government’s duty concept and ineffective of the government’s monitor.Therefore, this article concludes that in order to build an effective debt dispute prevention, they need the perfect in-depth analysis from the China relevant policies and regulations, internal management system of the private universities and the function of government, through the effective cooperation of the analysis, the mechanisms operation will be more scientific than ever and it will be used to prevent the debt disputes which are happened frequently in private universities, also it will maintain a stable development of the economics. For improving the relevant policies and regulations of the private universities, it will build a complete system of legal norms from the macro, and in-depth analysis of the effective of the debt disputes in private universities of property policies, return policies, financial subsidization, investment and financing policies, financial management and etc. For improving the internal management system of the private universities for building a perfect one, it needs to analysis from 5 categories:the clear and configuration of property, financial management systems, corporate governance structure, standardize property model, teacher management system. For completing responsibility of the government and its departments, it needs to change the government through the well understanding of private universities and encourage the government to strengthen the supervision of private universities.
