| In order to eliminate the bottleneck of the reform and opening up,China has been madding great effort in social transformation and economic transition,such as adjusting and improving laws and regulations of social society,which in one hand substantially raising the level of social security,on the other hand increasing the labor costs and reducing the profit of traditional labor-intensive industries.Therefore tens of thousands of companies,especially smaller ones,have collapsed or been forced to merge with others,or shift to different lines of production,which leading to the frequent occurrence of mass labor conflicts,intensifying the labor contradiction and influencing the social stability and public safety.As one of the most basic social relations,the stability of labor relations affects the relationship between economic development and social stability.So the CPC and our government have always paid great attention to the labor relations.This paper tries to offer rules to cast a light on relaxing the labor contradiction and finding a mutually acceptable solution to the collective labor disputes,by looking up and analyzing the literature,data statistics and cases,especially those collective labor disputes in Minhang District solved by the author and colleagues.With more and more collective labor disputes,some methods,such as transformation of the mode of economic development,adjustment of the income distribution system,perfection of the mechanism of appeals express and disputes prevention,are given in this paper,through analyzing on the cause of collective labor disputes,i.e.closure or restructuring of the enterprises due to slow down of the economy,information asymmetry and poor communication between the capital and the labor,the disputes caused by pursuing benefit maximization by both parties,as well as the lack of effective dispute solution mechanism. |
