Comparative Research On The Text Of University Statutes Between Yale University And Peking University

University statutes is like a soul of a university.It is a representation of university mission,which helps improve the contemporary university system and guarantee to push forward the scientific development of our university business at the same time.In our country,both the Education Law and the Higher Education Act all come up with the idea that universities should govern their own business according to the law. Whether it is in the legal aspects of the legislative requirements,or in the practical application of the legal system. The Development and improvement of university statutes has become the most important work of college construction.This paper selected two comprehensive universities which are very representative,namely Yale University and Peking University as the main object of comparative study.We have a discussion on the University Statutes and also conclude the reasons for differences, rasing some advice for further improvement of the University Statutes.Meanwhile,it also helps to provide some reference for our some of the universities which haven’t developed a university statutes of their own yet. The main part of this article is divided into the following chapters:The first chapter describes the study background of the article, the definition of university statutes, the aim and significance of study and the research method.The second chapter is a basic statement of definition,connotation, basic elements, historical context and the construction of university statutes.The third chapter is the key component in this article.We pick Yale University and Peking University for comparison. First discussed the difference of formulate body between the two schools. Secondly, in the content of Peking University and Yale University,we compare the educational philosophy and the architecture between the two.At last,according to the comparison,we made a conclusion.The fourth chapter discusses the revelation which American university statutes brings for us on the construction of the University Statutes. Including the status of the development and implementation of the statutes in our country.There are still a lot of problems existing in the process of building our own statutes.We should make a properly referring of foreign coutries and develop our statutes with its own characteristics.
