Comparative Research On Charters Of Peking University And Oxford University Under The Governance Theory

University Governance system is a part of State Governance system. It is a fundamental requirement of modernization of State Governance system and a pressing need for deepening integrated higher education reform and promoting the modernization of higher education so as to improve University Governance system and to achieve the modernization of University Governance capability. In recent years, universities have made great efforts on governance, particularly on university charters, as a university charter plays an important role in its governance. In order to deal with hot issues and difficulties in university governance, to truly achieve university autonomy and to run school in accordance with the law, it is an essential and effective way to establish an integrated university charter. A university charter standardizes, as its basic programmatic document, all aspects of university running, thus it is of great significance for construction of high-level universities and establishment of a modern university system.The paper is, from the governance theory point of view, to analyze the relationship between university governance and university charters. Thus it selects two university charters, Peking University Charter from China and Oxford University Charter from Britain, as analysis samples. The paper is divided into 5 chapters. Chapter 1 puts forward selected paper topic and research significance, makes a literature review, presents research contents and clarifies conceptual definitions; and it explains research layout and methods. Chapter 2 analyzes the relationship between university governance and university charter, including the content and main body of university governance, the structure and mode of university governance. Moreover, by analyzing the functions of university charter, it explores the governance value of university charter. Chapter 3 compares the differences and similarities between Peking University Charter and Oxford University Charter regarding its construction and legal effect; and Chapter 4 compares the context and the school-running philosophy within. Chapter 5 lands on the realization of university governance under a charter perspective. Firstly, it is to promote the legal status of university charter so as to give university governance laws to abide by; then in order to ensure university’s well function, the relationships among all interest parties should be clarified so that each one can perform his own function; moreover, the decision-making power of university governance should be increased in the manner of charter so that university governance shall no longer be just a university ideal; and the internal university governance structure should be improved. Though analyzing, the paper attempts to provide insights and references for the construction of our nation’s university charter, the improvement of modern university governance, and lastly the establishment a scientific modern university system.
