The university charter is the legal protection of university development,and it is also an important carrier of university governance structure.The analysis of the "university governance structure" in the university charter can summarize the experience of the reform of the university's governance structure and provide the basis for the perfection of the "university governance structure" in the next stage's development of university charter.At present,the study of the university charter is focused on the analysis of the basic problems of the charter construction and the introduction of the experience of foreign charter construction,A small number of scholars have done the contents analysis on the domestic university constitution.However,the samples selected by the research lack the university charts issued after 2013.On the other hand,the study of university governance structure is mainly for foreign university experience,country comparison,domestic university' s reform dilemma analysis,lack contents analysis of "university governance structure".Based on the above considerations,this study chooses to conduct empirical research on the university governance structure in the university charter issued after 2013.This study mainly analyzes the text of the university governance structure involved in the university charter from the "four aspects" and "the three levels"The four aspects are as follows:(1)the principal responsibility system under the leadership of the Party committee;(2)the Academic Committee;(3)the Congress of the staff and workers and the Congress of the students;(4)the school committee,the board of directors and the supervision mechanism.For each of the above aspects,this study is discussed from three levels:responsibility authority,staff composition,rules of procedure.In the research method,the content analysis method is used to combine the quantitative statistics with the qualitative analysis so as to reflect the overall situation of the sample institution and analyze the specific innovation content of each university.At the same time,to conduct a comprehensive examination of the typical colleges and universities.The main findings of this study are as follows:On the party committee under the leadership of the principal responsibility system,in the division of labor between party committee and the principal,the colleges and universities generally stipulate that the party committee has the core power of the university,including the decision-making power of major matters and the organization and personnel rights,and the principal has "making plans and implementation" Right,in general,the university president's power is weak,do not have the decision-making power of the school.There are two main ways to realize the cooperation between the party committee and the principal.The first is to invite the party or the principle to attend the other' s meeting.The second way is by virtue of the joint meeting of party and government.The way in which the academic committees participate in the governance of colleges and universities can be divided into two types in general.The first type is the "professors' academic management",the majority of colleges and universities take this model,the academic committees are limited to the management of academic affairs;The second type is the "professors' administration",a few colleges and universities provide academic committee the rights to participate in the school management.Most colleges and universities through the restrictions on party and government leaders to join the academic committee to the university to make a positive exploration of the getting rid of the administrative reform of the universities,however,the colleges and universities are not consistent with this provision.Some colleges and universities have constructed the guarantee mechanism of academic power,stipulated that the decision-making of academic affairs must be consented by the academic committee,which is conducive to the formation of restriction to administrative power and the solution of colleges and universities'administrative problems.Teachers and students participate in colleges and universities governance mainly through the faculty congress and the student congress,but in general,faculty congress and student congress still do not have the substantive right to participate in college decision-making,only a small number of colleges and universities got innovations and breakthrough in a few matters.There is a big difference among colleges and universities in social participation systems,the majority of colleges and universities set up the board of directors or the Council as a social participation organization of university governance.The right of the board to participate in college decision-making can be divided into three types,the first is for the provision of advice,the second is for the consideration or participation in the consideration,the third is for the highest decision-making.Most colleges and universities adopt the first two modes,only Shantou University provides the board of directors to master the school's highest decision-making power.In addition,the provisions on "university governance structure" of different levels of colleges and universities vary in details.Ordinary undergraduates' rules are more explicit than 211 universities',211 universities' rules are explicit than 985 universities'.This phenomenon may be related to the time of the development of the statutes of the three levels' universities and the policy documents on which they are based,also may be related to the strategy and degree of emphasis on the construction of the university charters at different levels'colleges and universities.
