Research On The Rights And Protection Of The Workers Of Yanbian Ethic Korean Area Who Working In The Republic Of Korea

The labor cooperation with the Republic of Korea has become the driving force to promote the rapid growth of Yanbian’s regional economy as well as one of the important sources of financial income in Yanbian region. But the existing problem is the lawful rights and interests of the workers of Yanbian ethic Korean area who working in the Republic of Korea cannot be timely and effectively protectduring working, and generally it became a new challenge to the development of the export of labor services in the Republic of Korea. Labor there cannot maintain their own rights and interests through the trade union organizations, lacking of democracy and political rights, being unable to obtain the equal right to employment, being suffering the wage arrears phenomenon seriously. Above mentioned will lead to the loss of economic rights and interests and be lack of professional training which seemed very difficult to cope with. So social basic right of labor to subsistence is actually not guaranteed, generally they become vulnerable groups in the judicial relief.Currently the main reasons for these difficulties includes the immaturity of China’s export of labor services market which made labor export market order confused, the insufficiency of the administrative supervision of the government ‘s rights protection mechanism, and being without a reasonable and effective solution to protect the rights of the labor dispute; workers has no rights and interests of the deletion of the legal system, can not provide legal basis for the rights of workers; plus labor service personnel overall quality is not high, staying in a weak position and with weak rights awareness.In order to improve the protection of the rights and interests of our country labor personnel, the author take the comprehensive analysis some advanced labor market with export business development such as Philippines, Japan, India and South Korea. The beneficial practices will be absorbed and the experience of other countries will be taken for reference.The paper proposes the five ways to protect the rights and interests of workers at Korea: first, to improve the legislative system of labor export, strengthen the legal applicability and operability. Second, to establish the institutions to manage the output of labor services, clearly define its legal responsibilities, and enhance the government’s service function of the export business. Third, crack down on the black middlemen, to protect the legitimate intermediary, the maintenance of labor export market order. Fourthly, to keep the personnel training of the labor exporting agencies for labor service. Fifth, to be focused on the strengthening of labor union organizations to protect the rights and interests of workers, to change the status quo of China’s labor unions.
