Study On The Countermeasures About Perfecting The Vocational Education Law In China

Vocational education legal system construction is an important part of modern vocational education system construction. The sound legal system of vocational education is also an important symbol of modern vocational education development. Thevocational education process of developed countries is a process of gradually establishing and improving vocational education legal system. In 1996, china’s "Vocational Education Law" was promulgated. The law is an important achievement of vocational education legal system constructionin our country whichmade a principled provision for vocational education in status, system, management system, finding guarantee mechanism, etc. It provides a powerful legal guarantee for the reform and development of vocational education in our country. This is a milestone in the history of the development of vocational education in our country.At present, the new trend of China’s economic development and new changes in vocational education development put forward new demands and new tasks for the legal system construction of vocational education, 20 years of implementation of the "Vocational Education Law" has lagged behind the development trend of vocational education and development concept of vocational education. The law is in urgently need of further revision and improvement. In the fourth Plenary Session of the 18 th CPC Central Committee proposed to comprehensively promote the strategy of rule of law. Education rule of law is an important part of the rule of law,vocational education as an important part of the education system. The important measure to promote the steady development of the vocational education by the rule of law is to establish a scientific and forward-looking legal support system for vocational education Revise and improve the current "Vocational Education Law" in China. It is not only in line with the new connotation of the strategy of governing the country according to law,but also in line with the new requirements of modern vocational education system.In this paper, it comprehensively apply some related knowledge of education and law,the main research methods are literature method and comparative method,the legislative background, content system and implementation effect of "Vocational Education Law" in our country. Starting from the educational equity, educational justice and lifelongeducationconcept,it pointed out the problems existing in the "Vocational Education Law" in our country which have been implemented for 20 years. And analyzed the necessity of perfecting the vocational education law from the new trend of economic development, the new changes in the development of vocational education and comprehensively promote the rule of law and so on.On the basis of the above analysis,it summarized the successful experience and enlightenment of the legal system construction of American and German vocational education and combined with the actual situation of the development of Vocational Education in our country to put forward the countermeasures of perfecting the vocational education law in our country,including a clear strategic position and development of vocational education concept, improving the relevant provisions of the vocational education system, promoting vocational education and school enterprise cooperation and improving the mechanism of funding for Vocational Education. The innovation of this paper is systematically analysis the legislative background, contents, implementation and problemsof China’s "Vocational Education Law " and try to draw lessons from the successful experience of the legal system construction in developed countries and combined with China’s reality to put forward countermeasures and suggestions of improving the "Vocational Education Law".
