| In 2006, the "special post plans" policy was published. Under the dual background of rural education s backward development and college students’ grim employment situation, the policy aims to guide the graduates to teach in "two bases" crucial counties of rural compulsory education schools for 3 years, and innovating the mechanism of rural teachers, narrowing the gap between urban and rural education level. After implementing for ten years, the "special post plans" has exposed so many problems. The reason is that low efficiency of contract enforcement, consciousness of the contracting parties, educational administrative departments took the dominant position in the contract and other factors resulting in special-post teacher’s legal rights have not been protected. After been admitted to the test, Special-post teachers will sign a written contract with County personnel department and educational administrative departments to set up contractual relation. The contract specified the rights and obligations of the two sides during the duration. It s no need to say that the importance of the contract to special-post teachers. If the contract is not exist, special-post teacher’s rights wouldn t be guaranteed.This study adopts the method of combining theoretical analysis and empirical research, analyzes their legal status and relationship with the other subjects in the contract based on the special-post teacher’s particulars, which in order to explore the nature of the special-post teacher’s contract. Then, took L city of Sichuan province as the survey area, in the following, conducted a questionnaire survey to 104 special-post teacher’s in this city and sampling some of them with in-depth interviews in order to obtain more reliable information.The survey results showed that special-post teacher s contracts still have many problems. First the contract content is imperfect, lack of legal provisions, contract subject incomplete, specific terms on-demand request, semantic fuzziness, etc... In the implementation process, the contract is in lowly utilities and the responsibilities of the subjects are not clear, also, the wages have different standards. Moreover, lacking of scientific system of assessment measures and effective monitoring and evaluation mechanism and so on. Then analyzed the problems from the policy itself, the education administrative department, positioned school and special-post teacher. Finally, based on the main problems, puts forward the countermeasures to perfect the contract, such as increased contract legal terms, define the duties of each subjects, intensify financial support, increase the supporting measures, improve related legal protection of t special-post teacher s contract and establish well psychological contract. |
