With the development of educational democratization, especially after the new curriculum reform, great importance are being attached to respect for students and the development of their personality. However, the relationship between education and punishment becomes chaotic. During the elementary education stage, on one hand,vicious events appears in educational practice due to some teachers’ abuse of their disciplinary power from time to time, which bring great damage to students’ body and mind. On the other hand, many teachers refrain from using any punishment to govern and discipline students because of their apprehension about anything related to punishment, which results in the disappearance of punishment in education. Thus,students’ wrong and improper behavior couldn’t be corrected by justifiable punishment in time. The students facing elementary teachers are young children immature both physically and mentally yet in a rapid development stage, thus some reasonable and justifiable punishment from their teachers could be beneficial for their growing up and development. Nevertheless, many vague spots in theory and practice still exist in the punishment in elementary schools. That’s why it’s not only the practical demand for the improvement of pupils’ physical and mental development but also the necessary measure to safeguard the legitimate rights and interest of elementary teachers to discuss the exercise of elementary teachers’ punishment rights,analyze the reasons behind improper punishment and thus help elementary teachers exercise their rights of punishment in teaching and educational activities in a scientific and reasonable way.This thesis consists of five parts.Part One, The Introduction, briefly introduces the origin of elementary teachers’ punishment rights, analyzes the practical and theoretical value of this study for elementary education and expounds and evaluates the related articles both home and abroad to establish the starting point of this study.Part Two, The Theoretical Analysis of Teachers’ Punishment Rights, analyzes the legitimacy of teachers’ punishment rights from the views of pedagogy, philosophy,psychology, law and etc. and at the same time analyzes the necessity of teachers’ punishment rights by relating the requirement for pupils’ healthy development,teachers’ fulfilling their duties, maintaining of school orders and other aspects, thuslaying the theoretical foundation for teachers’ punishment rights.Part Three, The Current Situation and The Problems of the Exercise of Elementary Teachers’ Punishment Rights, investigates the using status of the punishment rights in elementary schools in Weifang, Shandong by using investigation method and analyzes the related materials collected to get a better understanding about the using status of the punishment rights. According to some research, the main problems in the exercise of punishment rights in elementary schools include some teachers’ improper understanding about the punishment rights, the reasonable frequency, intensity and practice body and etc. and their lack in related skills.Part Four is The Reasons behind the Problems in the Exercise of Punishment Rights in Elementary Schools. According to the research, the reasons behind the problems in the exercise of punishment rights in elementary schools are really complicated, mainly including the missing of relative national policies, laws and regulations, the limitation of school management and teachers’ quality and the deviation in social concepts and consciousness.Part Five is The Countermeasure to Optimize Elementary Teachers’ Punishment Rights. Based on the analysis of the problems behind the exercise of punishment rights in elementary schools and its causes, this thesis offers its countermeasures to optimize elementary teachers’ punishment rights. First, the state should set up and improve the relative policies and laws to provide institutional guarantee, including clear legal provisions about teachers’ punishment rights, the specific implementing rules, the improvement of supervision and administration and the enhancement of the existing security system. Second, schools should strengthen the scientific mechanism of their educational punishment, including formulating their school regulations and rules in a reasonable way, providing scientific management and evaluation to their teachers, building up sound school-parent cooperation. Third, teachers should improve their comprehensive qualities about educational punishment, which means they should enhance their overall qualities, flexibly use various teaching methods,and actively master related skills about educational punishment. Forth, all sections of society should together create a positive atmosphere for educational punishment,including correct guidance from social media and the set-up of consulting organization to mediate and arbitrate relative disputes.
