With the continuous development of China’s real estate market, real estate industry wasestablished as the pillar industry of national economy, but in the real estate industry’s status isincreasing at the same time, with the high prices of the market is becoming more and moresocial attention. Due to for a long time didn’t correctly handle the relationship between themarket and the government, cause excessive government intervention, and can effectivelysolve the real estate market irrational exuberance. Facing the instability of the real estatemarket, on the other hand, due to the defects of market self-regulation, regulation needcountries using economic functions; On the other hand, due to the imperfect laws, regulationsand policies, the steady development of the real estate market also requires countries toperfect the related system and procedures. Because in recent years the national regulation andregulation policy, should be based on the analysis of the real estate market of related theoryand government regulation role of government regulation, the purpose is to through theresearch present situation and problems of the real estate market regulation, and draw lessonsfrom foreign experience, elaborated in the real estate market of the future, how thegovernment in accordance with the regulation in the legal system environment, so as to solvethe real estate market irrational exuberance, promote social progress of the people’slivelihood.This article through to the study of the theory of economics and law and analysis, usingliterature research, the literature related to the real estate market regulation and governmentresponsibility for collecting, sorting and research analysis, summed up the view of the realestate market regulation policy, different scholars and government regulation behavior ofdifferent analysis and countermeasures of great inspiration for my research. In addition, thepaper also use normative research and empirical research method of combining. Throughanalyzing the recent development of the real estate market and national implementation of thepolicy effect, analysis policy adjustment problems, draw on the experience of the real estatemarket regulation; Combined with using empirical research method, is analyzed by thenational bureau of statistics data, after analysing the data, sorting, an article in this paper.Due to the market self-regulation of the inherent defects, it is necessary to exert theeconomic law confirmation and standardize the government’s economic functions and the roleof power, maintaining the market order, stable economic development; On the other hand, dueto the relevant regulations and rules and regulations not perfect, the government in regulatingthe real estate market in the process of regulating improper behavior, there are mainly the government’s administrative intervention excessiveness but poor economic means to use thegovernment’s management is not standard and the central and local governments benefitgambling problems, leading to failed to correctly handle the relationship between the realestate market and the government, the effect of government regulation and rules cannotsatisfy the demand of the market, house prices is not reduced but increased trends, the realestate market continues to overheat. To do this, you need to prevent the government’simproper intervention of market mechanism, to correctly handle the "visible hand" and"invisible hand" relationship, promote the development of commercial housing marketstability.In actively advocate the construction of the government under the rule of law today, it isnecessary to give full play to the economic law of confirmation and standardize thegovernment’s economic responsibility and the role of power, maintaining the order of the realestate market and stable economic development, to prevent the government’s improperintervention of market mechanism, clear the government’s administrative authority, to perfectcommercial housing market to satisfy the needs of economic development and people’slivelihood.
