Research On The Realization Of Farmers’ Rights And Interests During The Process Of Collective Forest Tenure Reform

This paper is intended to respond the phenomenon that the farmers’ rights and interests are damaged during the process of collective forest tenure reform in China Various research methods such as literature research and questionnaire method are applied in this paper. By summarizing the concerned policies, regulations and laws, we define the farmers’rights and interests related to collective forest tenure reform which includes forestland contracted management right, woods ownership, disposition right, usufruct right and participation right. And we also analyze the standards of realizing these rights and interests. We take Shaanxi and Yunnan province as cases. Based on questionnaire survey, we give an empirical analysis for the status of realizing farmers’rights and interests during the collective forest tenure reform in Shaanxi and Yunnan Province. We find that the realization of farmers’rights and interests is influenced by various factors. As conclusions, we give the policy suggestions such as strengthening the policy implementation, reforming the commercial forest harvesting system and improving the payment system for non-commercial forest And we also give the multiple realization approaches including enterprise, social organization, the local rural autonomic organization and the farmers themselves.
