Women are the main force for the country to protect humanreproduction smoothly. And women make a significant contribution tonurture the next generation. International community has already agreedto this. In foreign countries, the universality of maternity security is verycommon. It is the trend of the times to actively and effectively buildsocial security systems to guarantee that women can enjoy the maternityright fairly and equally, although there are many differences amongcountries due to the history, culture, economic,social conditions and theapproaches.In recent years, China has also joined the rank of achievingsocialization and integration of maternity protection, and adhered to thepriorities of people’s livelihood, to promote the equalization of basicpublic services. The social insurance law of the People’s Republic ofChina and related laws "fertility security measures (exposure draft)" areall making further efforts to adapt to overall growth trend of security inurban and rural. However, the low level system of maternity protectionhas not got the social recognition and value compensation in china due tosome limits, such as historical legacy, the division between urban andrural, having a job or not,the nature of jobs and so on. China’s currentsystem of maternity protection not only cannot well disperse risks, protectwomen’s rights and interests, to achieve a smooth populationreproduction, but also make the fragmentation phenomenon of city andcountryside more serious and make the gap of treatment level betweenurban and rural more escalating. On the basic of China’s existing reality,the article will build new maternity protection systems for urban and ruralunder the guidance of positive welfare ideology, to achieve a unify of rights and obligations and achieve Pareto optimal balance between supplyand demand of the state and the individual.
