The Study On The Interest Conflict In The Process Of Land-levying In The Horizon Of Marxist Interest Theory

All kinds of problems arise in the process of land-levying in China, ultimately, is the problem of interest conflict. So, what the key to the right of researching this problem is defining concepts of public interest and personal interest. And under the basic social system of socialim, it is investigating the basic relationship between public interest and personal interest, which appeal to Marxist public interest theory, that provides rationale for solving this problem of conflict of interest. Meanwhile, through combinating the basic principle of Marxism and the concrete cases of developments of Socialst countries, relevent Marxist thoughts, which are developed and riched by Lenin, Mao Zedong, Deng Xiaoping, Jiang Zemin and Hu Jintao, are the guiding principles to solve the actual problem of interest conflict that arise in the current process of land-levying in China. Under the guidance of Marxist interest theory and relevent following developed theories, it is the important methods to solve the problem of interest conflict that transforming govermment functions and institutions, improving laws and regulations and applying game theory.It is economic foundation of analyzing the problem of land-levying that analyzing the problems of land price composition and land appreciation. Meawhile, the center of contradiction between public interest and personal interest is unjust division of profit under the mixed ownership model of china, and it makes problems insurmountable that the government abuses its power in the name of pubulic interest and relevent insititutions and laws are imperfect, and it intensifies conflict that a few peasants’excessive requirement and staffs in concerned area having weak sense of following laws and institutions.Guided by Marxist interest theory, with anatomizing the concrete causes that result in the interest conflict in land-levying process in china, we could propose effective measures and methods to solve the problem. According to use concrete instances and dates from the land-levying process in Xiangtan area, it is the main measures and methods which include establishing correct values view, defining the public interest, the role of government and the matters of compensation, and improving institution system, utilizing legal tools that this paper proposes.
