Research On Identification And Compensation Of Workers' Injuries In Construction Industry Of Nanchang City

With the acceleration of the pace of social and economic development,the probability of workers being injured in the labor process has increased significantly.In modern factories,workers face not only the risk of mechanical injury,but also the risk of occupational disease.The data shows that the proportion of migrant workers who go out to participate in endowment insurance and medical insurance is far lower than the national average.What is more serious is that the participation ratio of "five insurances and one gold" for construction migrant workers with higher occupational risks is far lower than that of manufacturing Industry migrant workers.This also means that the social security level of migrant workers in the construction industry with high occupational risks is lower,and it is more likely that they will have an occupational disease but no support.When a worker is injured in the course of labor,obtaining work injury insurance compensation is an important way to ensure that the normal life of the worker is not affected.In order to obtain compensation for work injury insurance,effective work injury identification and timely and reasonable compensation are key.According to the characteristics of the construction industry,this paper conducts a questionnaire survey on the related conditions of peasant worker's industrial injury insurance in the construction industry in Nanchang,summarizes the situation of insurance purchase,the identification of industrial injury and the compensation process,and summarizes the attitudes of the government and labor unions.The main problems in the identification and compensation of migrant workers' work injury insurance in the construction industry in Nanchang are incomplete work injury identification procedures,difficult determination of labor relations,long dispute settlement time,inadequate payment by employers,and obstruction of rights protection by multiple parties.Through interviews with relevant personnel,the reasons are analyzed from the four dimensions of system,government,enterprise,and migrant workers,and specific cases are explained in combination with typical cases.This article considers that the protection of the rights and interests of migrant workers in the construction industry is a long process that requires the joint efforts of multiple parties.It is suggested to carry out from the four aspects of detailed related laws and regulations,strong chemical injury propaganda,giving play to the functions of the government department,and strengthening the role of third-party organizations.
