As an important part of deepening reform, rural reform lays great emphasis on the reform of rural land system. The farmer-land relation is the basic relation among the rural production relations, so the right and interest of rural land is foremost to farmers. The full implementation of new urbanization attracting many farmers to cities to find jobs leads to large land uncultivated for lack of labor which is left to be transferred. Besides, the rural land, farmers’ precious property, needs to be transferred to realize its value. Rural land transfer is also a highly controversial topic in academia. Therefore, it’s self-evident that rural land transfer is of great importance. For a long time, the slow circulation of rural land transfer is the biggest bottleneck restricting the economic development in Nanyang city. Since the 3rd Plenary Session of 18 th CPC Central Committee, Nanyang city has explored many methods to encourage the rural land transfer. During the process, some methods have achieved success, while others haven’t come into effect for certain reasons. It must be of great realistic significance to study the reasons that hider the practice of rural land transfer.In reference to the measures for rural land transfer of other places, this paper, by adopting the theory of institutional change, the theory of appropriate scale of rural land management and rent theory, makes an in-depth study on the problems and constraints which slow down the circulation of rural land transfer of Nanyang city, on the basis of the Decision of the 3rd Plenary Session of 18 th CPC Central Committee on Rural Land Transfer Major Issues and the Opinions on Guiding the Orderly Transfer of Rural Land Management Rights to Develop Rural Management on an Appropriate Scale issued by the State Council in 2014.The study discloses that the main problems existing in rural land transfer process of Nanyang city lie in the following aspects: lack of agricultural industrialization, poor approaches to transfer rural land, little publicity about relevant policies, non-standard norms to regulate transfer practice, weak awareness of rural land transfer and inadequate support from village cadres. The main factors restricting the transfer of rural land are as follows: ineffective implementation of the registration of rural land contract and management rights, outdated transfer platform construction, decentralized rural land management rights, unsound market for rural land transfer, the town government’s compulsory measures, scale operators’ difficulty in obtaining loans and imperfect rural social security system.In view of the abovementioned facts, this paper concludes that in order to solve those problems existing in rural land transfer practice it’s advisable to adopt the following measures: enhancing government’s guiding and service performance, cultivating new agricultural economic entities, accelerating the registration of rural land contract and management rights, providing greater financial support for scale operators, strengthening the construction of rural land transfer platform and further perfecting rural social security system.
