Research On The Legal System Of Rural Land In The Process Of Urbanization In China

The paper is mainly to the current rural land law system in China under the background of urbanization situation and existing problems were studied. Purpose is to combine the present reality on the basis of the analysis of Chinese society, put forward some in the process of rapid urbanization, the rural land law system of our country reform proposals.The body of the thesis research is in the process of the urbanization of the rural land law system. The concept related to the urbanization of the rural land legal system to analyze, in close contact between them, emphatically analyzes the current problems existing in the legal system of rural land in the urbanization process, and finally put forward rational solutions to the problem.In China, the country is the direct motivation of legal system of rural land reform, and the social root of farmland legal system development in our country is the social interest structure. The present urbanization construction with contradiction existing legal system of rural land, led to the damaged the interests of farmers, rural development is slow. The goal of China’s legal system of rural land reform should be the pursuit of rural land resource reasonable utilization, to safeguard farmers’ interests, and actively promote modern construction.Land resources are strategic resources of our country’s fate. The current our country is in a critical period of the construction of the new type of urbanization, the land problem is a primary issue in the development of new type of urbanization. Land issues related to the survival of China’s vast peasant masses, issues related to the implementation of urbanization way, eventually will determine the success or failure of the urbanization development. Based on the town into the background, aims to address the current problems existing in the legal system of rural land, and then puts forward the new type of urbanization under the background of the direction of the land system reform and innovation, from the land ownership, the right to the contracted management of land, land circulation and the household registration system, and many other aspects points the way to the land law system perfect. Goal is to safeguard the interests of the masses of peasants, better service for the urbanization construction, to better serve the socialist development.
