Research On The Transfer Of Rural Contracted Land And Its Problems In The Process Of Urbanization

The problem of land circulation has been one of the important topics to which domestic and foreign scholars pay attention.Domestic scholars, from the respective of each subject areas, have taken some deep researches on the situations, the modes and the legal issues of rural contracted land circulation. Especially, most scholars tend to choose a larger geographical scope as a research object from the field of the economics and the law. However, there are lack of contextualized and procedural research on small-scale local practices,which needs to be deeply studied.Based on the analysis of the relationship between the development of urbanization and the contracted land in rural areas, this thesis analyzes the situation of problems of the rural contracted land circulation under the background of the rapid development of urbanization in China. It relys on the qualitative research method taking Q village in the north of Anhui province. This study divides the specific operation process of the land circulation into three stages: start-up stage, mobilization stage and the implementation stage. Therefore, it explores the main body of land circulation, especially villager's response and attitudes to it and the situation of what the local government has try to solve, in order to reveal the specific problems of the village in dealing with the rural contracted land circulation.The study finds that the rural constructed land circulation is an inevitable trend and also the rational choice of peasants in the process of urbanization in China.However, there are some serious problems such as the damage of villagers' interests,insufficient employment of villagers, the intensify of rural social stratification, the contracting of large contractors and the change of the contracted land for agricultural purposes.In view of the serious problems of the rural contracted land circulation, the thesis,on the basis of the basic principles which the circulation of the rural contracted land should follow, explores the countermeasures to promote the contract in terms of following aspects. Firstly, the assistance system of the rural contracted land circulation should be constructed as soon as possible. Secondly, market system of it should be established and improved. Thirdly, the procedures of it should be standardized. And finally, the legal protection of it should be improved.
