Study On Influence Factors Of China’s Enterprises PCT Patent Application

With the rapid development of economic globalization and knowledge economy, focus on patent of the intellectual property competition and comprehensive national strength competition is becoming increasingly intensified, many developed countries and Multi-National Corporation through the establishment of "patent barriers" and "patent litigation" constantly compresses the developing countries’innovation space. Under this background, China has formulated the "intellectual property strategy" and "going out" strategy, encouraging enterprises through overseas patent layout to develop international market. PCT is a popular tool and way of current international patent protection, the PCT patent application trend has become an important reflect of the global technology competition and the innovation development trend.In this paper, Use "Deep influence factors of our country innovation enterprise’s PCT patent application" as the research object, on the base of reviewing the exist literatures, carried out the following research work:First, relying on the latest PCT patent application panel data, using patent statistics and comparative analysis methods, analyze the current situation, characteristics and problems of China’s PCT Patent Application. Concluded that:China’s PCT patent application are rapid growing, however, there are still significant gaps with developed countries, the lack of cluster edge technologies, patent portfolio and the lower level of the PCT system using structural problems and contradictions.Secondly, First propose "the market protection motivation","the technique counter-performance motivation","the policy demand motivation" and "the strategic layout motivation" are four dimensions of the enterprise PCT patent application intrinsic motivation; First propose "the innovation environment"、the enterprise innovation ability"、"the cost of PCT patent application"、"the certainty of PCT patent application" are four dimensions of the enterprise PCT patent application external influence factors. Then first using "the intrinsic motivation of the patent application","the external influence factors of the patent application"、"the patent development Foundation" and "the patent development environment", constructed a model of our country enterprise PCT Patent applications drive system and strategic decision-making framework.Finally, on the one hand, doing content analysis of the "PCT patent application driven system model and strategic decision-making framework", and use cases summarized other deep-seated factors of PCT patent application. On another hand from the perspective of the macro policy and micro enterprise put forward the corresponding countermeasures and suggestions for enterprise PCT patent application.The main value of the paper lies in:(1) although China’s PCT patent application are the rapid growing, but structural problems and contradictions are still outstanding;(2) In contrast with developed countries, China’s enterprises PCT patent application’s traditional protect motivation is still more than the strategic motives;(3) China’s enterprises PCT patent application influenced by many complex factors but still has more in common factors;(4) initial construction of the "Chinese enterprises PCT patent application driven system model and strategic decision-making framework for enterprise patent" enriched the current "Enterprise PCT patent application strategy ".(5) Answered the question:"deep influence factors of China’s enterprises PCT patent application "and put forward the corresponding countermeasures and suggestions.
