A Study On Legal System Of The Support And Supervision Of Energy Performance Contracting In China

Energy Performance Contracting (EPC) is a new type of energy conservationproject investment mechanism based on market. This mechanism is to achieve theproject goal of energy conservation and emission reduction between Energy ServiceCompany and Target Company through the market contract form by the way ofcombination with the use of capital, production and technology. Under the help ofEnergy Service Company, Target Company can save energy consumption expense,enhance corporate profits, realize the reasonable utilization of social energy, in order toachieve the win-win.EPC sprang up in1970s in the western developed world by degrees. Later, onthe basis of this, the benefit-oriented and professional “energy conservation servicecompany” developed quickly and became mature energy conservation industrygradually. Our country imported EPC in the end of1990s and now the energyconservation industry has formed a basic shape after10years’ development. It plays apositive role in promoting energy conservation reform and diminishing energyconsumption. Nevertheless, due to problems like lack of supervision, support onfinance and tax, and financing difficulty, the development of EPC industry is restrictedto some extent. Therefore, it is no doubt an important question for discussion to deepenthe knowledge of EPC market and establish support and supervision system for thehealthy development of EPC market on solid evidence research from the nationalmacro-control.The first chapter of this paper is literature review and research plan. It analysesthe current EPC research at home and abroad and points our the deficiencies ofresearch on EPC at home. Then it discusses the research plan and methodology.The second chapter discusses the basic conception, participation main body,characteristics, main models and the development situation and development obstaclesof the EPC industry in our country. There are the uneven of main practitioners in themarket, the lack of norms of industry, the project financing difficulties, smaller supportof the government in our country.In the third part, the thesis reviews and evaluates the existing supportand supervision system about EPC in our country on the basis of the present situationand the obstacles of the development of China’s energy management contract.The forth chapter borrows polices and experience during EPC’s development from western countries and concludes the main characteristics of those polices.The fifth chapter probed into how to perfect the support and supervision system ofEPC in our country on the basis of the second and third chapter. It includes three parts:the update of ideas during legislation, the support of tax and finance policy, and thesupervision from government and the third-party.
