As an important system, IPR has been concerned by the international community. For China, a late-development country, treating the role of IPR in technical progress correctly and improving the technical progress by using IPR is necessary.We build a theoretical model based on general equilibrium analysis, introducing intellectual property protection and the degree of marketization to explore the relations with technological progress. The demonstration validates that the optimal level of protection of intellectual property rights really exists and it has relationship with the degree of marketization. According to the current marketization, we estimate the most optimal level of protection of IPR.Then comparative analysis with the real PR has been done. the main conclusions are as follows:(1)Intellectual property protection level of our country has a significant rise recently, but compared with developed countries there is still a large gap. There is a obvious gap among different provinces.The degree of these three indexes shows a tendency of decrease from east to west.(2)There exists an optimal level of intellectual property protection to maximize the technological progress. The most optimal level of IPR will be influenced by the degree of marketization. The lager degree of marketization,the lager degree of the optimal IPR. In addition, the increase of trade liberalization will also rise the value of optimal IPR but with less effectiveness comparing with the degree of marketization. We Estimate the average optimal IPR under China’s current stage of development level.The value is about2.941. We compare this optimal numerical value with the real value of IPR among provinces in China. It demonstrates that in addition to Beijing, Shanghai, Tianjin, Jiangsu, Zhejiang and Guangdong, other all provinces have not reached the present optimal IPR for the average level of the whole country during this stage. The east provinces have less gap between the optimal IPR and the real IPR than the west provinces.(3)When the level of IPR is low, the increase of the marketization degree will reduce the proportion of innovating enterprise; when the degree of IPR is high enough, the increase of the marketization degree will promote enterprises transfer from imitation to innovation. The effect of technological progress was not significant currently. The present level of IPR and the degree of the marketization can’t fully harmonious and unified.(4) The innovation’s influence on the technological progress should be greater than the influence of foreign direct investment and imports. So the transition from technical imitation to technical innovation is the requirements for the development of this stage.
