Construction Project Bidding System Reform Based On The Balance Of "Power Control" And " Picking Over "

In the field of construction in China tendering and bidding system is a basic system. It is playing an important role for improving the efficiency of the construction project investment and construction project transaction. However, there are many problems in the practice of the construction project bidding and tendering, such as together-conspired bidding, contacting bid, black case work and inappropriate winning bidder, etc. The problems result in that many professionals have a negative cognition to the necessity and value of the bidding system. Why can these problems appear? How should bidding system be reformed with constantly promoting social and economic system reform in our country? The study of these problems has theoretical and practical significance.The paper combed the main problem of construction tender and bid activities in our country through the literature research. One of the reason that the function of “control” and the function of “merit” have conflict and contradiction was proposed through the study of the essence of tendering and bidding system. At present our country emphasize the functions of "control" based on the need of anti-corruption, but the function of “merit” weakened to a certain degree.Combined with the overall market environment of our country at present, the reform of the bidding and tendering system is necessary in view of the causes of problems. At the same time the general idea of reforming the system of bidding and tendering, which is the balance of power control and picking over, has been proposed. Considering the excessive power control, it was proposed that the limiting conditions of invitation to bid, the limiting conditions of the bidders’ site survey, the relevant provisions of candidate winning bidders determined by the tenderees and the rules of selection mode to choose the members of a bid assessment committee by the tenderees should be cancelled. Considering the insufficient picking over,it was recommended that classified standard text and bid evaluation method should be used scientifically and bid assessment committee and bid evaluation expert should be deep reformed on the basis of the return of the rights. The relevant matching systems of construction project bidding and tendering system need to improve at the same time of reform the system itself. The improvement of the system mainly includes consummating legislation and supervision mechanism, improving the structure of the construction system and reforming tender agency system. Hence, construction project bidding and tendering system need to reform with bidding and tendering system reforming and the relevant supporting system improving. The results of the paper have an important reference value for the reform of construction project bidding and tendering system.
